PATRIOT COAL CASE INFORMATION

The Debtors’ jointly administered chapter 11 cases and the associated adversary proceedings have been transferred to the United States Bankruptcy Court for the Eastern District of Missouri, effective as of December 19, 2012. The main case, Patriot Coal Corporation et al., Case No. 12-51502, has been assigned to the Honorable Kathy A. Surratt-States. All Further Motions, Pleadings and Papers Should Be Filed on the Docket of Case Number 12-51502 in the United States Bankruptcy Court for the Eastern District of Missouri.

On July 9, 2012, Patriot Coal Corporation and substantially all of its wholly owned subsidiaries (collectively “Patriot”) filed voluntary petitions for reorganization under chapter 11 of the United States Bankruptcy Code in the Bankruptcy Court for the Southern District of New York. On November 27, 2012, an Order was entered which transferred the Patriot chapter 11 proceedings to the Bankruptcy Court for the Eastern District of Missouri. Patriot intends to use the reorganization process to make necessary changes and ensure the Company’s future viability.

Patriot expects its mining operations and customer shipments to continue in the ordinary course throughout the reorganization process. Patriot remains committed to serving its customers and maintaining safe, productive operations as it undertakes this process. The Company has received approximately $800 million in new financing and intends to move through this process as quickly as possible.

On October 18, 2012, the Bankruptcy Court entered an order establishing December 14, 2012 at 5:00 p.m. (Prevailing Eastern Time) as the last date and time for each person or entity (including, without limitation, individuals, partnerships, corporations, joint ventures, estates and trusts), other than any governmental units (as defined in section 101(27) of the Bankruptcy Code) ("Governmental Units"), to file a proof of claim against Patriot (a list of affiliated Debtors can be found here). Solely as to Governmental Units, the Bar Date Order established January 21, 2013 at 5:00 p.m. (Prevailing Eastern Time) as the last date and time for each such Governmental Unit to file a proof of claim against the Debtors.
